1. Definitions

In these Terms:

2. Eligibility and registration

To register as an Operator you must:

Aviparko reserves the right to decline or suspend applications at our discretion.

3. Pricing and fees

Monthly subscription
£19
Per car park, per month
Platform fee
5%
Of each driver payment, deducted before payout
Service charge
25p
Per transaction, charged to the driver

The £19/month subscription is billed monthly per active car park. The 5% platform fee is deducted from each driver payment before it is paid out to the Operator. The 25p service charge is added to the driver's total at checkout and does not reduce Operator revenue.

Example: A driver pays £5.00 for parking. The driver pays £5.25 (including the 25p service charge). Aviparko deducts 5% (£0.25) and the Stripe processing fee, and the Operator receives the remainder. The Operator also pays £19/month separately.

Prices are exclusive of VAT where applicable. Aviparko reserves the right to change pricing with 30 days' written notice.

4. Payouts

Operator payouts are processed automatically via Stripe Connect at 06:00 GMT each day for the prior day's completed sessions. Payout timing is subject to Stripe's standard processing schedule, which is typically 2–3 business days after the charge date for new accounts, reducing as the account builds payment history.

Operators must maintain a valid, verified Stripe Connect account. Aviparko is not liable for payout delays caused by Stripe processing, bank processing times, or account verification issues.

5. Operator responsibilities

By using Aviparko, the Operator agrees to:

6. Warden access and enforcement

The Aviparko warden tool provides real-time session verification only. Aviparko does not issue Parking Charge Notices, operate as a bailiff, or provide debt recovery services. The Operator is solely responsible for enforcement at their site, including the issuance and pursuit of any PCNs.

Warden PINs must be kept confidential. The Operator is responsible for all activity under their warden credentials.

7. Platform availability

Aviparko aims for high availability but does not guarantee uninterrupted service. Planned maintenance will be communicated where possible. Aviparko is not liable for lost revenue resulting from platform downtime, Stripe outages, or connectivity issues beyond our reasonable control.

Operators should maintain a contingency plan for periods of technical unavailability (for example, a contact number for manual payment arrangements).

8. Intellectual property

All platform software, design, copy, and branding is the intellectual property of Aviparko. Operators are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose during the subscription period. No other rights are granted.

Operators must not reverse-engineer, copy, or resell any part of the platform.

9. Limitation of liability

To the maximum extent permitted by law:

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Termination

Either party may terminate the Operator's subscription at any time with no notice period and no termination fee. Termination takes effect at the end of the current billing month — the Operator will not be charged for the following month.

Aviparko may terminate or suspend an account immediately if the Operator:

Upon termination, access to the operator dashboard will cease. Session records are retained for 7 years in line with financial regulations and made available on request.

11. Driver payments and refunds

Payments made by Drivers are processed by Stripe. Drivers with payment disputes should contact Aviparko at amirvieyra@yahoo.com. Refunds are assessed on a case-by-case basis against session records.

Aviparko does not process refunds for sessions where a driver has parked and the session data confirms a valid payment was made.

12. Changes to these Terms

Aviparko may update these Terms from time to time. Material changes will be communicated to Operators by email with at least 14 days' notice. Continued use of the platform after the notice period constitutes acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you have a complaint, please contact us first at amirvieyra@yahoo.com. We aim to resolve all complaints within 5 business days.
